Introductory Note:

Video: Nigeria Must Now Rework Its Union Arrangements To Achieve Better Governance Structures & Outcomes.

The following clarifications are being made to explain to the audience, the “Outsourcing” referred to by the guest in this Interview AND therefore to help guide us to the fountain from which the multidimensional failures and dysfunctions of Nigeria flows, including Corruption, Impunity Insecurity, Bad Governance, systemic and institutional failures, Infrastructural Decay, Serial Electoral Malfeasances which makes impossible, the emergence of any form of Good Leadership in the arena of Governance.

The need for these clarifications is driven by the fact that any search for solutions to the problem we call “Nigeria”, which does not trace and extinguish the source and fountain of the problems, is futile and bound to fail like several others before it, undertaken in misdiagnosis of the problem, (which is basically, Structural Deformity) especially those revolving around the search for better Leadership for Nigeria via Elections.

Listening to the brilliant Postulations of this speaker on the concept of Outsourcing the Organization and Management of the Enterprise called “Nigeria” to the Body called “Government”, by the “Peoples of Nigeria”, it has become necessary to, on behalf of the Nigerian Indigenous Nationalities Alliance for Self-Determination (NINAS), provide the following clarifications, particularly because the issues thrown up by the “Outsourcing of Organization” Postulation, align significantly with the Thrust of the NINAS Union Reconfiguration Propositions for the Distressed Federation of Nigeria.

The one word of describing the totality of the Transaction by which the Peoples of Nigeria outsource the Management of Nigeria to the body called the Government, is CONSTITUTION which is the Formal Instrument by which the Peoples of Nigeria, as owners of the Enterprise called Nigeria, outsourced the organization and management of the enterprise (ie governance) to the body called Government.

To understand that outsourcing transaction more clearly, we could look at the wordings of Nigeria’s 1999 Constitution which at Section 14(2a) admitted that: “Sovereignty belongs to the Peoples of Nigeria, from whom, Government, through this Constitution, derives all its Powers and Authority.”

This simply means that it is the Peoples of Nigeria, (ie constituent components aggregated as Nigeria), who as the owners of the enterprise (Nigeria), will have to Discuss, Negotiate, Agree Upon, Codify and Ratify the Charter (Constitution) by which their Union is Created (Memorandum of Union) and Terms of their Union (Articles of Association) are spelt out.

It is by this Charter that the Government and all its Institutions are created. It is by this Charter that all the Powers, Responsibilities and Authority of all the Government and its institutions are defined, delineated and delimited.

The overwhelming majority of the problems bedeviling and ravaging Nigeria today, flow from the fact that the Nigeria enterprise was hijacked and the hijackers, in usurpation of the Sovereignty of the Constituent Peoples of Nigeria, IMPOSED a Union Charter (Constitution) of their own making, without any reference to the Constituent Peoples of Nigeria who are owners of the Sovereignties Aggregated as the Nigerian Union as proclaimed in the aforementioned Section 14(2a) of the 1999 Constitution.

That Imposition, done by Military Fiat via Abdusalam Abubakar’s Decree Number 24 of 1999, is encapsulated in the PREAMBLE to the 1999 Constitution of Nigeria which Falsely Claims that:

(1) We, the Peoples of the Federal Republic of Nigeria;

(2) Having Firmly and Solemnly Resolved To Live In Unity, as One Indivisible and Indissoluble Nation;

(3) Do Here Make, Enact and Give Ourselves the following Constitution.

The unambiguous proof of this Foundational Falsehood is provided in full by the contents of the aforementioned Decree Number 24 of 1999 as reproduced in the 1999 Constitution, which clearly outlined the processes by which Nigeria’s departing Military Junta of the time, cobbled together the document it labeled “the 1999 Constitution of Nigeria”, promulgated into operation, effective May 29, 1999 by the said Abdusalam Abubakar’s Decree Number 24 of May 5, 1999.

By these Notes of Clarification, NINAS is inviting all who seek and Clamour for Change in Nigeria, whether they seek Outright Exit from the Distressed Federation of Nigeria or Restructuring for Regional Autonomy or better Leadership and Good Governance by way of Elections, TO Take a step back and first get a clearer understanding of the Problem they seek to solve, so that they can evaluate the viable options available to them and the action-sequence dictated by the logic of the situation, particularly the choice BETWEEN heading to Elections in 2027 under the 1999 Constitution for Change of Political Leadership AND the initiation of a Transitioning Process in 2026 for the wholesale Constitutional Reconstruction of Nigeria.
