No Revolution Is More Far-Reaching Than The Ousting Of Constitution For Orderly Union Reconstruction: Invitation To NINAS Pathway To Redemption.

(This note is for those who advocate ‘Revolution’ as the remedy to Nigeria’s complex maladies and those who seek Good Governance, and Greater Autonomy or even exit from the Nigerian Union, but who stand aloof from the tedious tasks being undertaken by NINAS in the Process of Taking Down the Imposed Unitary Constitution of Nigeria, to make way for the Changes being desperately sought by Nigerians currently trapped in the Nightmare Unitary Nigeria has become for all).

(1) Quite often, we see in the public space, comments and enquiries that suggest that many in Nigeria, including the highly educated, do not understand the central place of the prevailing Constitutional Arrangements of Nigeria in how the society they live in is structured or organized; nor in the scheme of the things they see all around them, Good or Bad, including Security, Economy, Infrastructure, Environment, Distribution of Opportunities and Responsibilities, Human Rights, State Institutions, the Law et cetera, NEITHER do they seem to understand the concept of Sovereignty which defines their place in the Constitution of that Society they live in.

(2) It is in response to such comments and enquiries that this note is being put out on behalf of the NINAS Secretariat, to help those who genuinely seek answers to the dangerously dysfunctional society Nigeria has become as well as the inexplicable paradox of Mass Poverty in the midst of the great endowments of Nigeria, human and material.

(3) It is against the backdrop of the foregoing that we can say that those who do not yet recognize the NINAS-led Campaign for the Delegitimization, Decommissioning, and Dismantling of the Unitary Constitution of Nigeria as the REVOLUTION that it is, (albeit staggered), urgently need to take a closer look.

(4) In the face of the Countrywide Consensus against the Unitary Constitutional Arrangements of Nigeria, particularly the painstaking processes that have been undertaken across the 24 Years from 1999 by NINAS and its constituent and precursor entities (including PRONACO, MNN, and LNC), more particularly, the Detailed Propositions of the NINAS Constitutional Force Majeure Proclamation of December 16, 2020 which was the culmination of the meticulous processes deployed to oust that Constitution, it would be wrong to suggest, as some commentators are doing, that no Propositions have been advanced for the Wholesale Decommissioning and Dismantling of the Fraud we call “the 1999 Constitution”.

(5) If we were to find the discipline to first define the CHANGE we seek before we proceed to the question of what viable options are available for attaining that change, we will have no difficulty in recognizing the Propositions of NINAS for the Revolution it is or in seeing the Clear Pathway it provides for the Reconfiguration and Reconstruction of the Damaged Constitutional Foundations of Nigeria.

(6) Considering the fact that the Unworkable Unitary Constitutional Arrangements of Nigeria are directly responsible for the Multidimensional Failures of Nigeria and that Elections Under that Constitution only reinforce those Failures, it must be stated that in the face of the Painstaking Efforts of NINAS to point Nigerians to the NO-ELECTION Pathway to Redemption, Nigerians who heedlessly plunged from one Election cycle under the 1999 Constitution since 2003, 2007, 2011, 2015 and 2019, all the way to the one of 2023 are complicit in the sustenance and reinforcement of their own Damnation. 

Accordingly, the FIRST BLAME for the disasters currently swarming over Nigeria and Nigerians, MUST GO to those who ignored the Loud Counsel of NINAS against the Doomed Electoral Voyage of 2023 under the 1999 Constitution, as well as the NINAS Prescription of a TRANSITIONING Process to Renegotiate, Reconfigure and Reconstruct the current Untenable and Unworkable Constitutional Basis as the Framework for Nigeria, in place of Elections.

(7) Let it be noted also that the 5-Point Proposition of NINAS, offers Nigeria a Peaceful Process of Resolving the Long-Standing Nigerian Question in a manner that could result in a Proper FEDERATION, a CONFEDERATION or the emergence of Independent Units of Successor-Sovereign State Entities from the ruins of the Defunct Federation of Nigeria which collapsed since the 1966-1967 toppling of the Federal Constitutional Basis of Nigeria.

(8) As Consensus continues to grow Countrywide around the Rejection of Nigeria’s Unitary Constitution and the Clamour for the Constitutional Reconstruction of Nigeria (loosely called ‘Restructuring’), NINAS would like to make clear the fact that the Restructuring that will address the Grave Constitutional Grievances of the Constituent Components of Nigeria is beyond the Legislative Mandate of the National Assembly. That Assembly does not have Constituent Powers required to make any Union Constitution. NINAS does not accept the 2014 National Conference Report as the basis of any Restructuring since that Conference expressly shut out any discussions on the Disputed Constitutional Basis of Nigeria, and NINAS does not advocate the return to the 1963 Constitution as that leaves the so-called Minorities of the North (Middle-Belt) and the Minorities of the East (Niger Delta) in the belly of the Majority Ethnic Groups of those Regions. (That is, Incomplete Decolonization)

(9) To the Extent that the Constitution means Union Agreements, the discussion that must now happen to remediate the Damaged Constitutional Basis of Nigeria is one amongst and between the Ethnic Constituent Components (i.e. Peoples) of Nigeria to settle the two long-standing questions of (1) Whether they want to continue as one Political Union AND if Yes, (2) On What Terms?

(10) It goes without saying that the Union that will be discussed will be a Union of Sanctity of Life and a Union of Equality of Men. Sharia and Feudalism both of which now constitute preliminary objections to the continuation of the Union to those who do not subscribe to either (i.e. South and Middle Belt).

It also goes without saying that the default to finding common ground is immediate Union Dissolution. 

(11) With the foregoing clarifications, we make bold to assert that the NINAS 5-Point Proposition remains the most viable remediation to the raging Fulani Conquest Invasion as well as the most potent mechanism for arresting the brazen State Capture that came with the untenable outcome of Nigeria’s 2023 Presidential Election. As Nigeria Bleeds from all sides even amidst its Free Fall, the Cost of Delaying the Deployment of this Potent and Ready-For-Use NINAS Remediation Template will be enormous.
