The Distressed Federation Of Nigeria And Remediation Options: Between The Search For Better Leadership And Constitutional Reconstruction

Amidst heated debates in a Nigerian Diaspora platform about the Proceedings and Prospects at the Presidential Election Petition Tribunal, someone wrote a post suggesting that Peter Obi was the perfect answer to the problems of Nigeria. 

Tony Nnadi of NINAS responded to the post as follows:

“No doubt at all that between candidate Peter Obi and the other candidates (ie Bola Tinubu and Atiku Abubakar), Peter Obi is to be preferred for the Presidency of a Nigeria struggling with issues of monumental corruption and countless other debilitations. 

The question however is whether the debilitations of Nigeria flow from mere “Bad Leadership” as Peter Obi posits or from the more Fundamental Constitutional Anomaly as NINAS posits.

A simple Cause-Effect Analysis of the Nigerian Quagmire will bring us very quickly to the conclusion that Nigeria’s unworkable Unitary Constitutional Arrangements is the fountain from which Nigeria’s many debilitations flow, including monumental corruption and the jinx of unending Bad Leadership.  

That Analysis should also settle for us, the question of Remediation Sequence and Priority between searching for Better Leadership and embarking on a Comprehensive Constitutional Reconstruction. 

It is against the backdrop of these preliminaries that I will proceed to explain to us why, in place of the perennial but elusive search for “Better Leadership” NINAS is persuaded that the urgent Priority at this time is the Liberation of the Constituent Components of the Defunct Federation of Nigeria from the Bondage of Unitary Nigeria erected upon, and defined by Nigeria’s Death-dispensing Unitary Constitution (1999), imposed since 1979 as the Victory Charter from the War of 1967-1970 by the War Alliance of 1967 that came in Genocide against the East, in pursuit of what they described at the time as “One-Nigeria”.

Following over 20 years of Painstaking Work of Consensus-building and Multi-Layered Alliances built for Resolving Nigeria’s many Debilitations, NINAS had in December 2020, Declared a Union Dispute by way of a Constitutional Force Majeure with a Five-Point Proposition for Grand Union Reconfiguration involving:  
(1) The Suspension of Further National Elections under the Repudiated 1999 Constitution, (including 2023 General Elections) and;
(2) A TRANSITIONING Process for the complete Decommissioning of the 1999 Constitution and the Renegotiation of Fresh Constitutional Protocols predicated on the Self-Determination Imperative for the Trapped Constituent Components of the Failed Lugardian Experiment of 1914.

For the same reasons as we saw in Apartheid-era South Africa, NINAS is certain that other than a Complete Constitutional Reconstruction, there is no other viable solution to Dysfunctional Nigeria erected upon that Worse-Than-Apartheid Unitary Constitution of Nigeria (1999) and so the first order of business in any Remediation for Nigerians or Nigeria must be the Wholesale Jettisoning of the Fraudulent 1999 Constitution.

Peter Obi, in gross-misdiagnosis and for reasons that defy logic, reason and evidence, convinced himself otherwise and therefore declared at the start of his Presidential Campaign, that the Constitution of Nigeria is not the problem with Nigeria and that the problem was simply that of Bad Leadership which his emergence as President will address.

Peter Obi also declared in course of his Campaign that there was no Ethnic Problem in Nigeria and that the difficulties being tagged Ethnic were caused by widespread Poverty which the Good Leadership (that he would provide as President of Nigeria) would cure.

He then began to reel out Economic Statistics from all over the world for how he would cure what is clearly a Deep-Seated Political Problem rooted in Constitutional Anomaly like one who is planning to fetch water with a basket (nkata) or a skilled driver that will drive a vehicle with a knocked engine (which was how he, Peter Obi, described the Unitary Constitution of Nigeria in 2021 in relation to the aforementioned System-induced Debilitations of Nigeria).

Everything Peter Obi said or says he would/will do, is made IMPOSSIBLE or Untenable by the Unitary Constitution of Nigeria. 

Whoever does not understand this Is simply ignorant and in the case of the Peter Obi who already likened Nigeria’s situation to that of a Vehicle with a Knocked Engine (Unworkable Constitution), we could be talking about Dishonesty, unfortunately.

Now, the 2023 Election has happened. Peter Obi won by a clear margin but he has not become President. 

The main reason for that outcome is the Over-Centralized Control of Nigeria’s Electoral System as imposed by the Unitary Constitution of Nigeria. 

Secondly, even as incontrovertible evidence abound before the Courts that Peter Obi won the Election, NINAS which was the first to tell the Global Community that Peter Obi won the Election in the week of the Declaration of False Election Results, but also told the world that the reason Peter Obi is being denied Victory by the Hawks of Nigeria’s 1967 War Alliance, is that he is Igbo. 

Now Peter Obi and his Obidient followers are waiting on the Courts, controlled 100% by the Alliance of 1967 that is determined to hold the East in servitude, for Justice, ignoring that those Courts are merely an arm of the same Evil System that Stole the Mandate.

Talk of choosing to learn the Hard Way.

The Decisive Roles of the Unitary Constitution of Nigeria and Ethnic Factor in the outcome we have so far seen from the 2023 Presidential Election should now persuade those who did not understand the Logic of the NINAS Propositions that unless the Fundamental Constitutional Question is Addressed, every other attempt to change anything in Nigeria is an exercise in Folly and Futility.
